1. The Service

Boosta is an AI-powered sales intelligence platform that helps users identify potential business prospects, generate personalised outreach content, and manage sales pipelines. The Service includes:

• Access to a database of publicly available Australian business information
• AI-powered prospect matching based on your business profile
• Personalised email content generation
• Sales sequence automation
• Analytics and reporting tools

2. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

You must be at least 18 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Acceptable Use

You agree to use the Service only for lawful business-to-business sales and marketing purposes. You must NOT:

3.1 Email and Outreach

• Send unsolicited bulk email (spam) using content generated by Boosta
• Use the Service to send emails that violate the Australian Spam Act 2003
• Misrepresent your identity or the purpose of your outreach
• Send outreach to individuals who have opted out or unsubscribed
• Use automated sequences to contact individuals without a reasonable basis for doing so
• Exceed sending volumes that would constitute bulk unsolicited messaging

3.2 Data Usage

• Scrape, copy, or redistribute the business data provided through the Service
• Use the Service to build a competing database or product
• Attempt to re-identify anonymized or aggregated data
• Share your account credentials or provide access to unauthorized users
• Use the data for purposes unrelated to your legitimate business activities

3.3 Technical

• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Circumvent usage limits, credit restrictions, or access controls
• Introduce malicious code, viruses, or harmful material
• Interfere with or disrupt the Service or its infrastructure
• Use automated scripts or bots to access the Service except through our official API

3.4 General

• Use the Service for any illegal purpose
• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Harass, threaten, or abuse any individual or business

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these terms.

4. Credits and Billing

4.1 Credit System

The Service operates on a credit-based system. Different actions consume different amounts of credits as described in your plan. Monthly credit allocations reset at the start of each billing cycle and do not roll over.

4.2 Paid Plans

Paid plans are billed in advance on a monthly or annual basis. All prices are in Australian Dollars (AUD) unless otherwise stated. Prices may change with 30 days' notice.

4.3 Free Plan

The Free plan provides a limited allocation of credits per month at no cost. We reserve the right to modify the free plan's features and limits at any time.

4.4 Refunds

We offer a 14-day money-back guarantee on your first paid month. After this period, payments are non-refundable. If you cancel a subscription, you retain access until the end of your current billing period.

5. Intellectual Property

5.1 Our IP

The Service, including its software, design, content, algorithms, and documentation, is owned by Boosta Pty Ltd and protected by Australian and international intellectual property laws. These Terms do not grant you any ownership rights in the Service.

5.2 Your Content

You retain ownership of any content you create, upload, or generate through the Service (including your business profile, prospect lists, and customised email content). You grant us a limited license to process, store, and display your content as necessary to provide the Service.

5.3 Generated Content

Email drafts and other content generated by our AI are provided as suggestions. You are responsible for reviewing, editing, and approving all generated content before sending. We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content.

6. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

6.1 Business Data

The business information available through the Service is sourced from publicly available records. We make reasonable efforts to keep this data accurate and current, but we do not guarantee the accuracy, completeness, or timeliness of any business data.

6.2 Your Obligations

When using business data from the Service for outreach, you are responsible for ensuring your activities comply with all applicable laws, including the Australian Privacy Act 1988, the Spam Act 2003, and any relevant state or territory legislation.

7. Service Availability

7.1 Uptime

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

7.2 Modifications

We may modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes that affect your use of the Service.

7.3 Data Retention

If your account is terminated or you cancel your subscription, we will retain your data for 90 days. After this period, your data may be permanently deleted.

8. Limitation of Liability

To the maximum extent permitted by Australian law:

• The Service is provided “as is” without warranties of any kind, express or implied
• We do not warrant that the Service will meet your specific requirements or produce specific results
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claims arising from these Terms or your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

9. Indemnification

You agree to indemnify and hold harmless Boosta Pty Ltd, its officers, directors, and employees from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law
• Content you send using the Service
• Any third-party claims resulting from your outreach activities

10. Termination

10.1 By You

You may close your account at any time through your account settings or by contacting us at support@boosta.so.

10.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You fail to pay applicable fees
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Australia.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
